La liberté de conscience a une dimension à la fois individuelle et communautaire. Principalement dans le domaine religieux, elle renvoie à des traditions et à un environnement. Elle relève donc à la fois du droit privé et du droit public, selon une logique « culturelle ». Tout droit culturel est un « droit de passage » entre le privé et le public, entre le for interne et le forum externum . Les convictions religieuses sont culturelles au plus haut degré (elles tendent à intégrer toutes les activités de la vie individuelle et sociale), et le champ religieux se présente ainsi comme un accomplissement du culturel. Mais en même temps, les religions risquent de vouloir nier la diversité culturelle, en se présentant comme le modèle unique. Il faut considérer que l'affirmation de la liberté de conscience n'est pas seulement une régulation politique externe, mais une condition minimale d'authenticité religieuse interne. Nul ne peut prétendre posséder seul la vérité, qu'il s'agisse de la justice, de la démocratie ou a fortiori du divin.

La liberté de conscience fait partie du « noyau intangible » des droits de l'homme. La Déclaration universelle des droits de l'homme de 1948, suivie par la plupart des autres instruments internationaux, proclame ensemble le droit à la liberté de pensée, de conscience et de religion . Il est difficile de distinguer clairement les trois. Le droit à la liberté de conscience se traduit par exemple par le droit de changer de religion ou de conviction. Au for interne, la liberté de conscience ne connaît aucune restriction. Mais sa manifestation externe peut connaître certaines limitations. Ainsi, la propagande en faveur de la guerre, l'appel à la haine raciale ou religieuse, l'incitation à la discrimination, ne sont pas protégées par le droit à la liberté de conscience. La jurisprudence du Comité des droits de l'homme de l'ONU et celle de la Cour européenne, concernant par exemple l'objection de conscience ou le paiement des impôts, précisent peu à peu les critères de l'exercice concret de la liberté de conscience.

Le contenu de la liberté de conscience est assez proche en France et en Allemagne. Cependant, en France, la liberté de conscience apparaît comme étant la notion-clé, alors que ce rôle est plutôt attribué à la liberté de religion en Allemagne.

L'Église catholique a pour valeur première la vérité, à laquelle il faut adhérer. Cependant, Vatican II a reconnu aussi la valeur de la liberté : on ne peut contraindre quelqu'un à adhérer à la vérité. Il y a, dans la doctrine catholique actuelle, une tension entre ces deux exigences : celle de l'adhésion à la vérité et celle du respect de la liberté. On assiste aujourd'hui à un renforcement de la protection de la vérité (par exemple Ad tuendam fidem ), au détriment de la protection de la liberté. Le Code continue de sanctionner les catholiques qui, au nom de leur liberté de conscience ou de religion, veulent quitter l'Église. De même, là où l'Église catholique est en position de force ( la Pologne ), elle a tendance à moins promouvoir la liberté de conscience que dans les pays où elle est minoritaire ( la Russie ). Mais, en même temps, la liberté effective des membres de l'Église est aujourd'hui plus grande que jamais.

La théologie orthodoxe induit une conception du politique très différente de celle de l'Occident. Selon la conception orthodoxe, au plan interne, la conscience l'emporte sur la loi positive. Mais, au plan externe, des notions comme la séparation Église-État sont peu pertinentes. Les orthodoxes, surtout les Byzantins, privilégient la « symphonie » identitaire, pouvant aller parfois jusqu'à l'assimilation nation-religion (phylétisme). La culture byzantine combine ainsi une conscience personnelle (interne) libre et une conscience communautaire (externe) très affirmée. La doctrine des droits de l'homme, telle qu'elle s'exprime dans la Déclaration universelle de 1948, est d'inspiration occidentale. Elle privilégie une conception individualiste des droits et libertés, au détriment de la dimension communautaire. La question est donc celle de l'universalité des droits de l'homme.

Le respect de la liberté de conscience ne s'est imposé que difficilement aux religions et aux États, au prix d'un immense travail de réinterprétation des traditions. L'écart est évident entre Luther ou Calvin, qui sont loin d'être des militants de la tolérance, et les Lumières, auxquelles certaines tendances du protestantisme ont largement participé. Il fallut redéfinir la conscience dans le cadre de l'individualisme moderne, ce que firent en particulier John Locke à la fin du 17 e siècle, ou Alexandre Vinet au 19 e . L'ecclésiologie protestante, elle aussi, lorsqu'elle a réussi à éviter l'intolérance sectaire, a contribué à la démocratisation de la société. Aujourd'hui, la tolérance risque de devenir une méta-valeur qui tend à tout niveler dans l'indifférence, si l'on n'en garde pas les deux faces : respect d'autrui (face négative), mais aussi convictions argumentées (face positive).

Le terme sharî'a ne désigne pas la loi musulmane, mais plutôt la religion elle-même. Elle est une source, parmi d'autres, de l'élaboration des normes relatives aux conduites des humains. Le sens qui lui a été donné, récemment, de « loi religieuse », résulte d'une instrumentalisation politique de la religion : la désobéissance au pouvoir peut ainsi être présentée comme une hérésie, de même que, inversement, l'obéissance au pouvoir politique est présentée par les groupes radicaux d'opposition comme une apostasie de la « loi divine ». Aux début de l'islam, il y eut des périodes de tolérance et des périodes de guerre. Les interprétations divergent sur ce qui, chez Mahomet, relève du religieux (et qui est donc constitutif de l'islam) et ce qui relève du politique (et qui est donc contingent). Le Coran lui-même reflète deux positions dialectiques, militante et tolérante.

Le ius remonstrandi est le droit d'un évêque diocésain de contester une loi du pape et même de refuser de l'appliquer, s'il estime qu'elle nuit au diocèse qui lui est confié. Ce droit de remontrance épiscopal se trouve déjà dans le Corpus Iuris Canonici . Il est, mutatis mutandis , comparable au droit accordé aujourd'hui à certains fonctionnaires de refuser d'appliquer un ordre inapproprié ou injuste.
Emmanuel Tawil , Le Conseil pontifical pour l'interprétation des textes législatifs et le respect de la hiérarchie des normes dans le droit canonique actuel

Diverses prérogatives ont été attribuées au Conseil pontifical pour l'interprétation des textes législatifs afin d'assurer le respect de la hiérarchie des normes en droit canonique. Il lui revient de contrôler la conformité du droit particulier au droit universel de l'Église. En outre, le Conseil s'est reconnu compétent, dans la déclaration du 24 juin 2000 concernant l'accès des divorcés remariés à l'eucharistie, pour procéder à une interprétation du droit ecclésiastique conformément au droit divin. Mais cette déclaration n'étant pas elle-même une interprétation authentique, sa portée reste problématique.

Les établissements de santé confessionnels ne bénéficient pas en France d'un statut qui les différencie des autres institutions publiques et privées. Cette situation s'explique par les orientations données par la Révolution française et la législation napoléonienne. Les établissements de santé confessionnels doivent dont s'inscrire dans des cadres juridiques plus vastes. Le droit français distingue les institutions de santé et les institutions à caractère social, ce qui représente un obstacle à la mise en œuvre d'établissements dont l'action s'inscrit dans l'un et l'autre de ces domaines. Ces établissements s'organisent sous la forme d'associations à but non lucratif et sous la forme de fondations autonomes reconnues d'utilité publique. Deux exemples sont développés : celui des religieuses travaillant dans les hôpitaux et celui des organismes caritatifs tel le Secours catholique

Freedom of conscience has both an individual and community dimension. Especially in the sphere of religion it reflects tradition and environment. It falls, therefore, within the ambit of private law and of public law. All law relating to culture is applicable as private law or public law, in the internal forum and in the external forum. Religious beliefs are very much a matter of culture (they involve all life's activities, individual and social) and religion appears as the high achievement of culture. Yet religions tend to reject cultural diversity in claiming to be the unique version. It must be borne in mind that the assertion of freedom of conscience is not merely an outward rule of policy but a minimum requirement of authentic in religion. Nobody can claim to be the sole possessor of the truth, be it in the matter of justice or of democracy or, a fortiori, of divine truth.

Freedom of conscience forms part of the “intangible kernal” of human rights. The Universal Declaration of Human Rights of 1948 which was followed by most of the other international documents asserts at the same time the right to freedom of thought of conscience and of religion. It is difficult to make a clear distinction between the three. The right to freedom of conscience finds expression, for example, in the right to change religion or belief.
In the internal forum there is no restriction on freedom of conscience. However, there are some limitations on its external manifestation. Thus propaganda in favour of war, appeal to racial or religious hatred, incitement to discrimination are not protected by the right to freedom of conscience. The jurisprudence of the the Human Rights Committee of the UNO and that of the European Court regarding, for example, conscientious objection or the payment of taxes clarify gradually the criteria governing the exercise of freedom of conscience in the concrete.

In France and in Germany freedom of conscience signifies more or less the same thing. However, in France the emphasis appears to be more on freedom of conscience, where as in Germany freedom of religion appears to be the key concept.

In the value system of the Catholic church the truth to which one must adhere holds primacy of place. Yet, Vatican II recognised liberty as a value : one can not force a person to adhere to a truth. In Catholic teaching today there exists a tension between two requirements : adherence to a truth and respect for freedom.
Today there are signs that safeguarding truth is being emphasised (for example Ad tuendam fidem) to the detriment of freedom. The Code continues to pronounce sanctions against Catholics who wish to leave the Church, following their freedom of conscience or their freedom of religion. Likewise, in places where it enjoys a position of power ( Poland ) the Church tends to advocate freedom of conscience less than it does in countries where it is in a minority ( Russia ). At the same time, members of the Church enjoy today more real freedom than they ever enjoyed.

In Orthodox theology political thinking differs greatly from political thinking in the West. In Orthodox thinking, in private, conscience prevails over positive law. But, publicly ideas such as separation of Church and State have little pertinence. The Orthodox and especially the Byzan-tines favour the harmony which results from identity, sometimes going as far as blending nation and religion (phyletism). Thus Byzantine culture combines a conscience which is personal (internal) and free with a conscience which has a community dimension (external) and is very assertive.
The doctrine of Human Rights as it is set out in the Universal Declaration of 1948 is western in its inspiration. It favours an individualist concept of rights and freedoms to the detriment of the community dimension. The question, therefore, is that of the universality of human rights.

Regard for freedom of conscience was imposed only with difficulty on religions and on states. It was imposed at the price of much work carried out reinterpreting traditions. The difference is evident between Luther and Calvin who are far removed from being enthusiasts for tolerance and the adherents of the Enlightenment in which people with certain protestant leanings played a prominent part. It was necessary to redefine conscience in the context of modern individualism, which John Locke in particular did at the end of the 17 th century or Alexander Vinet did at the end of the 19 th . When it succeeded in avoiding sectarian intolerance, Protestant Ecclesiology contributed to the democratisation of society. Today tolerance runs the risk of being a value which tends to have an eroding effect leading to indifference, unless two aspects of it are preserved : respect for the other person which is the negative aspect and also convictions which are well substantiated, this being its positive aspect.

The word sharî-a does not signify Muslim law but rather the religion itself. It is a source among others for the elaboration of norms for human behavoiur. The meaning which as been given to it in recent times, namely “religious law”, results from the use of religion for political purposes ; in that way disobedience to the civil power can be represented as heresy while, conversely obedience to the civil power is represented by radical opposition groups as apostacy from divine law.
At its inception Islam experienced periods of tolerance and periods of war. Interpretations differ as to what, according to Mahomet, was within the sphere of religion (and is therefore an essential element of Islam ) and what was within the sphere of politics (and is therefore incidental). The Coran itself reflects two arguable positions, one militant, the other tolerant.

“Ius Remonstrandi” is the right of the diocesan bishop to raise an objection to a pappal law and even to refuse apply it, if he considers that it is injurious to the diocese entrusted to him. This right of episcopal remonstrance was already included int eh “Corpus Juris Canonici”, “Mutatis Mutandis” it resembles the right accorded at present to certain officials to refuse to carry out an order which is inappropriate or unjust.

The Pontifical Council for Legislative Texts has been granted various prerogatives for the purpose of ensuring that the hierarchy of laws is respected in canon law. It is responsible for ensuring that particular law complies with the Church's universal law. In addition, in its declaration of 24 June 2000 on admission to Holy Communion for remarried divorcees, the Council stated that it had jurisdiction to interpret ecclesiastical law in accordance with divine law. However, as this declaration was not itself an Authentic Interpretation, its scope remains problematic.

In France , health institutions run by religious confessions are not granted a special status that would make them different from other public or private institutions. This situation can be explained by the orientations given by the French revolution and napoleonic legislation. Confessional health institutions must therefore be set within larger legal frameworks. French law distinguishes between health institutions and social assistance institutions, which constitutes a hindrance to the creation of institutions acting in the two fields at the same time. Health or assistance institutions are set up as non-profit associations and as autonomous foundations serving the public interest. Two examples are developed: that of nuns working in hospitals, and that of charitable organizations such as the Secours Catholique.

Die Gewissensfreiheit erstreckt sich gleichzeitig auf den individuellen sowie den gemeinschaftlichen Bereich. Vor allem im religiösen Bereich beruft sie sich auf Traditionen und auf ein soziales Umfeld. Sie bezieht sich also, nach einer „kulturellen“ Logik, sowohl auf das Privatrecht wie auf das öffentliche Recht. Alle mit der Kultur verbundenen Rechte bewegen sich zwischen Individuum und Öffentlichkeit, zwischen dem eigenen Innersten und dem forum externum . Die religiösen Überzeugungen sind im höchsten Maße kulturell ( sie tendieren dazu, alle Tätigkeiten des individuellen und des gesellschaftlichen Lebens zu integrieren) und deshalb erscheint das religiöse Umfeld als eine Vollendung des kulturellen.
Gleichzeitig aber besteht das Risiko, dass die Religionen die kulturelle Verschiedenheit verneinen wollen, indem sie sich als das einzige Modell ausgeben. Man muss bedenken, dass das Recht auf Gewissensfreiheit nicht nur eine rein äußerliche politische Regulierung sondern eine Minimalbedingung für jede interne religiöse Authentizität darstellt. Niemand kann behaupten, er besäße als Einziger die Wahrheit, sei es in der Justiz, in der Demokratie oder a fortiori im Göttlichen.

Die Gewissensfreiheit gehört zum „unantastbaren Kern“ der Menschenrechte. Die universale Erklärung der Menschenrechte im Jahre 1948, gefolgt von den meisten anderen internationalen Vereinbarungen, verkündet gleichermaßen das Recht auf Gedanken-, Gewissens-, und Religionsfreiheit . Es ist schwierig, diese drei Rechte eindeutig zu unterscheiden. Das Recht auf Gewissensfreiheit bedeutet zum Beispiel das Recht, die Religion oder die Überzeugung zu wechseln.
Im Innersten kennt die Gewissensfreiheit keine Einschränkung. Ihre Anwendung kann jedoch unter Umständen beschränkt werden. Demzufolge werden Kriegspropaganda, Aufruf zum rassistischen oder religiösen Hass, Anstiftung zur Diskriminierung nicht von dem Recht auf Gewissensfreiheit geschützt. Die Rechtsprechung der Kommission für Menschenrechte der UNO sowie diejenige des Europäischen Gerichtshofs, z.B. im Bereich der Kriegsdienstverweigerung oder der Besteuerung, verdeutlichen mehr und mehr die Kriterien der konkreten Ausübung der Gewissensfreiheit.

Was unter Gewissensfreiheit verstanden wird, ist in Deutschland und Frankreich nicht sehr verschieden. Jedoch erscheint die Gewissensfreiheit in Frankreich als der Schlüsselbegriff während in Deutschland diese Rolle eher der Religionsfreiheit zugeordnet wird.

Die katholische Kirche kennt als höchsten Wert die Wahrheit, der man unbedingt verpflichtet ist . Jedoch hat Vatikan II auch den Wert der Freiheit anerkannt: niemand kann dazu gezwungen werden, sich der Wahrheit zu verpflichten. In der aktuellen katholischen Kirchenlehre besteht eine Spannung zwischen beiden Forderungen: zwischen der Verpflichtung zur Wahrheit und der Achtung der Freiheit.
Heutzutage erlebt man, wie die Wahrheit, zum Nachteil der Freiheit, verstärkt geschützt wird (z.B. Ad tuendam fidem). Der Codex bestraft weiterhin die Katholiken, die im Namen ihrer Gewissens- oder Religionsfreiheit aus der Kirche austreten wollen. In gleicher Weise tendiert die katholische Kirche dazu, in Ländern, wo sie eine starke Position besitzt wie in Polen, die Gewissensfreiheit weniger zu fördern, als in Ländern wie Russland, wo sie eine Minderheit ist. Aber gleichzeitig ist die tatsächliche Freiheit der Kirchenmitglieder heute größer denn je.

Die orthodoxe Theologie hat ein Politikverständnis, das von dem westlichen sehr verschieden ist. Nach der orthodoxen Auffassung ist auf interner Ebene das Gewissen dem positiven Gesetz übergeordnet. Auf externer Ebene sind jedoch Begriffe wie die Trennung von Kirche und Staat wenig sachdienlich. Die Orthodoxen, vor allem die Byzantiner, bevorzugen die „Sinfonie“ der Identität und können sogar bis zur Gleichstellung der Nation mit der Religion gehen (Phyletismus). So verbindet die byzantinische Kultur ein (internes) persönliches Gewissen mit einem (externen), sehr stark geprägten gemeinschaftlichen Gewissen.
Die Lehre der Menschenrechte, wie sie in der universalen Erklärung von 1948 zum Ausdruck kommt, wurde von den westlichen Werten inspiriert. Sie bevorzugt eine individualistische Auffassung der Rechte und der Freiheiten, auf Kosten der gemeinschaftlichen Dimension. Es stellt sich also die Frage nach der Allgemeingültigkeit der Menschenrechte.

Nur mühsam konnte sich die Achtung der Gewissensfreiheit bei den Religionen und Staaten durchsetzen und zwar dank einer immensen Arbeit bei der Neuinterpretation der Traditionen. Zwischen Luther oder Calvin, die man nur schwer für Verfechter der Toleranz ausgeben kann, und der Aufklärung, zu der manche Strömungen des Protestantismus durchaus beigetragen haben, ist der Abstand offensichtlich. Die Gewissensfreiheit musste im Rahmen des modernen Individualismus neu definiert werden, was insbesondere John Locke am Ende des XVII. Jahrhunderts oder Alexandre Vinet im XIX. gemacht haben. Auch die protestantische Kirchenwissenschaft, insofern es ihr gelungen ist, die Intoleranz des Sektierertums zu vermeiden, hat zur Demokratisierung der Gesellschaft beigetragen. Heute riskiert die Toleranz ein Meta-Wert zu werden, der dazu neigt, in der Gleichgültigkeit alles einzuebnen, falls man diese zwei Seiten nicht beibehält, nämlich den Respekt vor dem Anderen (negative Seite) aber auch begründete Überzeugungen (positive Seite).

Der Ausdruck sharî'a bezeichnet nicht das moslemische Gesetz, sondern eher die Religion selbst. Sie ist neben anderen eine Quelle der Ausarbeitung der Normen, die sich auf das menschliche Betragen beziehen. Die diesem Ausdruck neuerdings zugeschriebene Bedeutung eines „religiösen Gesetzes“ erfolgt aus einer politischen Instrumentalisierung der Religion : der Ungehorsam gegenüber der Macht kann so als Häresie dargestellt werden. Auf die gleiche Weise kann im Gegensatz dazu der Gehorsam gegenüber der politischen Macht von radikalen Oppositionsgruppen als eine Abtrünnigkeit vom „göttlichen Gesetz“ dargestellt werden.
In der Frühgeschichte des Islam wechselten Zeiten der Toleranz mit Zeiten des Krieges. Die Interpreten sind sich nicht einig darüber, was bei Mohammed religiös (also grundlegend für den Islam) und was politisch (also zeitbedingt) zu sehen ist.

Das ius remonstrandi ist das Recht, über welches ein Diözesanbischof verfügt, um ein päpstliches Gesetz anzufechten oder sogar um sich zu wiegern, ein solches anzuwenden, falls er überzeugt ist, dass es der ihm anvertrauten Diözese schaden könnte. Dieses bischöfliche Remonstrationsrecht findet sich bereits im Corpus iuris canonici . Es ist, mutatis mutandis, vergleichbar dem Recht, das manchen Beamten heutzutage zugestanden wird, sich zu weigern, einen unangemessenen oder ungerechten Befehl zu befolgen.

Verschiedene Vorrechte wurden dem Päpstlichen Rat für die Interpretation gesetzlicher Texte zugeteilt, damit er die Beachtung der Hierarchie der Normen garantieren kann. Er hat die Aufgabe, die Übereinstimmung des Ortskirchenrechtes mit dem universellen Recht der Kirche zu kontrollieren. Darüber hinaus hat sich der Rat in der Erklärung vom 24. Juni 2000 betreffend den Zutritt der geschiedenen Wiederverheirateten zur Eucharistie für zuständig erachtet, eine dem göttlichen Recht gemäße Interpretation des Kirchenrechtes vorzulegen. Aber diese Deklaration, die ja noch keine authentische Interpretation ist, bleibt in ihrer Tragweite problematisch.
